General Debt Recovery Process in Tanzania

While there are no specific laws solely for debt collectors in Tanzania, the process is generally governed by the Law of Contract Act and civil procedure rules. The recovery process typically follows these stages:

  1. Internal Reminders: The process usually begins with polite reminders, followed by more aggressive notifications for overdue payments (e.g., 30-90 days past due).
  2. Formal Letter of Demand: If internal efforts fail, a formal demand letter is issued, often by legal counsel. This letter outlines the debt amount, due date, and potential consequences of non-payment.
  3. Mediation and Negotiation: Before resorting to litigation, efforts may be made to negotiate payment arrangements with the debtor, considering their financial situation.
  4. Legal Action (Litigation): If the demand is ignored, the creditor can initiate legal proceedings by filing a claim in a competent court (e.g., High Court or Resident Magistrate’s Court or Primary court) depending on amount claimed. The court will issue a judgment if the claim is uncontested.
  5. Enforcement of Judgment: If a debtor still does not comply after a court judgment, enforcement can be sought through various means, such as a writ of seizure and sale (auctioning the debtor’s movable property) or a garnishment order (withholding funds from the debtor’s bank account or salary).

Establishing well-defined credit policies is a key preventative measure for effective debt collection.
